Also, she can't resell the phone anyway because she's under contract! AT&T effectively gave her $200 toward the phone, now she owes them. This is common practice in the US, but not elsewhere.

My brother bought the 4 GB model of the iPhone at launch, and he received the $100 rebate. The only reason she wouldn't have been eligible for the rebate is if she bought it within 14 days of the price drop. If that was the case it was her bad for not returning it.

Its called supply and demand. After a little while in the market apple decided the sweet spot for the phone was in the $400 price range.

Apple is greedy. They knew there loyal followers would pay $600. Once the followers bought one they lowered the price to a more competitive price that non-apple fanboys might pay.

Now on to your statements regarding corporations.

Making only a 10% gross margin over your R&D is ABSOLUTELY REDICULOUS (not to mention that is not how any company would attempt to set a price for a product, R&D is just ONE cost that goes into pricing). Margins like that would mean you couldn't pay your employees, give benefits of ANY sort etc. not to mention that your NET profit would probably be negative. And what in the WORLD does "moderately necessary" mean???

It always irks me when people act as though all companies should basically have a not-for-profit mindset. A "fair" price and a "fair" profit is whatever a customer is willing to pay. If a company is making a large profit, that's just fine, it means they will be around to make more products, expand business, hire more people and so on. Not to mention that not every product is a smash hit, meaning that a company has to make its money when given the chance because the future is never certain.

Supply and demand is an inescapable law. You cannot ignore it and attempting to manipulate it is typically a futile effort (except in VERY specific cases like a monopoly which does not apply here).

Naturally this case will be dismissed and she should indeed have to pay Apple's legal fees. My prediction, however, is that Apple will offer her a full refund and a free 8gb iPhone to drop the suit before it ever goes to court....she will then proceed to sell the iPhone on Ebay.

One lawyer proabably costs more money than that woman makes in a year. It would make more sense for Apple to give away a free phone to shut up an idiot, rather than spending one day in court. This is really one perfect example of the major problems plaguing the United States. Too many morons that cannot accept personal mistakes. Instead of learning from the mistakes, they go on to make bigger ones.

Two year contracts basically prepay part of the cost of a new cell phone, but they are fundamentally non-competitive because the early cancellation penalty is not prorated. You could cancel the contract after 22 months and you pay the same penalty as if you cancel it in the 2nd month, even though the phone has substantially depreciated after 22 months (if it even still works), but bared is near new after only two months. Cell companies would use mutually compatible phone hardware instead of making cell phone company unique locked to a carrier phone if competition were continuous and not just every two years. If you change phone companies you new company could pay the depreciated value of the phone to the old company. Besides, every customer who signs a contract more than 14 days before a price reduction gets angry at being left out of the offer since they can't drop the cell company.

I'm from Ireland and have lived/worked in the US for 2 years now. One point of note is that the average US consumer just doesn't really understand the mobile phone market. US phones are cheaper and usually much lower spec to European phones (no 3G comes to mind).

The drop in the iPhone pricing is just like the price drop of every upper tier mobile that comes out.. Motorola Razr (V1) anyone? Remember when that abomination came out in europe? It cost a fortune and dropped dramatically when the V2, V3 etc came out months not years later.
