The real reason he is suing Best Buy instead of the employee is that Best Buy has more money. They did not indicate if it was a crt or lcd tv. LCD tv's are lighter in weight than crt tv's. He will probably wants a huge amount of money after exagerating the injury.

Lets be honest here, the guy is suing Best Buy because they have the money. Whats the point in suing a Best Buy employee, they work for Best Buy its not like they have the millions of dollars this guy is seeking.

I have to agree with Sam Fisher. Most any other retail store either requires a "spotter" or closes the aisle when removing heavy object off high shelves. Albeit this guy should have known better than to stand under it, it doesn't change the fact that BestBuy did not follow or enforce proper safety precedures. Some companies would, at the very least, have to report this as an OSHA incident which is subject to fines and regulatory review; let alone any civic lawsuits due to injury. BestBuy will end up paying for this regardless of whether the guy was an "idiot" or "has no common sense". God bless America!

Don't just about all TVs have the warning sticker showing a picture of a TV falling on someone's head and stating that you should not stand under one? Best Buy should ban this guy from their stores and have him arrested for wreckless conduct and disturbing the peace.

Sue the guy for not catching properly. You should never let a good tv fall if you have a chance to catch it.

This is about as lame a lawsuit as the woman who got burned by hot coffee. Many have mentioned above, it's just common sense not to stand under someone moving a tv off a high shelf. But then again, common sense doesn't seem to apply to lawsuits... Sad.

Sam is already stepped aside but the drop is headed to his direction over the air as mostly, the drop would not be straight down because the employee would try to save the TV.

If this guy has actual injuries, of course he should sue. Neck injuries can last a lifetime when scar tissue forms between the vertebrae. A business is liable for creating an unsafe environment for its customers and workers.

To set the record straight about the woman and the drive-thru cup of coffee.

McDonald's had been cited numerous times for the temperature of the coffee exceeding health and safety guidelines.

The woman received extreme burns, second and third degree burns, from coffee much hotter than it should ever be served at.

The woman approached McDonald's and only wanted some money to pay for her medical treatment, McDonald's refused.

Being passed unnaturally hot coffee thru a little window, a person sitting sideways in a vehicle below the window has a reasonable expectation that they can't be injured by some clumsy minimum wage worker.

I worked at Best Buy too and we had to do 4 or more trainings on getting stuff off of the top shelf. We were also instructed to have the customer get out of the aisle due to morons like this.

Also the hot coffee issue was that it was too fricking HOT...it caused 3rd degree burns, so McD. was liable. People don't have common sense. That's why there are signs on everything including, "Warning, this cup of hot coffee is actually HOT!" People do stupid things. If you had beaten up the clerk, the clerk would have a right to sue you for assault and battery and then the judge would have put you in jail for assault and battery.

If the person was killed? How heavy is the box that dropped? Perhaps the person thought they could handle the box and ignored store policy? There is packing surrounding the tv. Could it not have absorbed some of the impact? There are so many questions that could have been answered.

These kinds of lawsuits are indeed stupid. If this guy was standing directly under the TV, he was taking a gamble. There comes a point when each person has to take charge of their own well being. Hope for the best, assume the worst.

Look I do not care about all these so called questions. How heavy was the box? Could he have gotten out of the way in time? Reality is you know it was a 27" tv and on a high shelf. That means do not stand underneath it when you know it is being moved or handled by someone. What you going to sue cause you where an idiot? Think the fault is on both Best Buy and the customer. Best Buy for maybe not training employees properly in this situation and the customer for just being dumb enough to stand under it when he first asked the employee to get it so he knew that he was asking for a 27" tv and that it was on a high shelf and being handled. Lawsuits are seen as a way to make big business pay for negligence. Everyone here is just mad because it wasnt them that this happened to. Everyone here knows they would sue in a heart beat if someone dropped a TV and it hit you. Best Buy needs to be taught a lesson. Getting heavy objects off the top shelf was not stressed enough during training, but I bet it now will be stressed alot.

The weight of a 27" TV can easily kill someone falling off a top shelf. Maybe we should just wait for someone to die before sueing for negligence.

The mcdonalds case is valid. My son had hot coffee spilled on him and got first degree burns. This is expected. No blistering, just alot of pain and crying. When second and third degree burns are encountered the coffee was way to hot. But lets not sue until a child inadvertantly knocks it over on themself and has to have a skin graft to reduce scaring just from second degree burns.

The article didn't say anything about the TV being in a box. Plus, if Fisher was admiring a TV then I highly doubt he was admiring the box.

I assume it was a CRT as Best Buy doesn't tend to put the LCD sets way up on the high shelves. Go into a store and look for the CRTs: they tend to be grouped in the back aisles and arranged on shelves. On the other hand, the LCDs are up front and center and low (because they make good eye-candy).

Furthermore, pretty much nothing on display is boxed up.

I suspect Fisher offered to assist the employee, and stood below waiting for the employee to hand the set down to him.

This guy, like every other (potential) customer in that store, was in the store under the assumption that the place was safe. Obviously, you're last thought is that a TV is going to fall from the ceiling. If instead of this guy getting hit by a TV, what if it was a child walking back to their parents? Would you blame the child? Why is it that now you don't blame the child but blame the man? Do you think that once you grow up you've lost your right to feel safe in a business? There weren't any warning signs that the place may have been a risk to your life. Depending on how it hit him, he could have easily died, not knowing how far up the TV was placed.

This is sort of like a hypothetical case where you're in a gun store, and ask to see one of the pistols. The clerk hands you the gun but slips and shoots you. The gun shouldn't have been loaded. The TVs shouldn't have been stocked where they can fall and injure/kill people. Would you sue the gun shop for gross negligence? Why not sue Best Buy, they are liable.

I simply can't believe what the poster above (pomaikai) said. Please, if a TV dropped on me because I was standing underneath when they were taking it down, it is my fault. Among all the things that could happen, worst case is that is will fall and it will hit me. If my help is not needed to get it down, common sense tells me to move from underneath and to a safe distance.

Coffee, feel the cup, is it hot? Then to the cup holder it goes and if there isn't one, the place it somewhere else. Again, common sense tells me something hot usually burns, if I can't drink it then it won't make contact with me until it cools down a bit.

Kids, common sense again, anything that can be knocked down WILL BE KNOCKED DOWN if a kid is present, it is only a matter of time.

Accidents happen.

That being said, negligence is an horrible thing, it happens to this day and it should be punished. However true negligence goes farther than the previous examples. A park owner that skips a few maintenance checks to save some money, a gas pump owner that lets the tanks leak into the ground, mixes up gas with water or dumps used oil behind the store, power stations using toxic chemicals without proper controls in order to save money...

Now those deserve to be sued.

A TV dropped on your head? Not unless you weren't aware of the moving (or were targeted by rogue BB employees) and then maybe, just maybe, it would stick and then only to be paid hospital, therapy and legal expenses, not become rich.

As it is, it looks more likely the guy was trying to help when he shouldn't have, but we don't know the whole story, so it is just conjecture.

I wouldn't be caught standing right under the 200 lb tv. It's common sense to keep a safe distance from anything high up that might drop off and hit you on the head.

I say the customer has as much fault as the store employee.

It is an urban legend that MickeyD's serves or used to serve their coffee abnormally hot. They serve it at the temperature that it should be brewed at, and then keep it at that temperature and serve it in cups that are designed to maintain that temperature until one gets to wherever one is going. To drink it one must remove the lid and let the heat out. To serve it at a temp that would not cause severe burns would mean not brewing it properly and serving tepid, weak coffee. The same rules of brewing apply to tea. Coffee/tea need to be brewed at least 180 degrees F. So McD's puts up with the lawsuits from careless klutzes in order to serve customers decent coffee.
These people need to suck it up.

Lets focus on where the blame should be placed. Er, arbitrarily, the employee should have called in sick that day after eating all those bad fava beans, so it might actually be 50% his fault. Which is *exactly* why I'm taking today off, just to be safe.

I think the guy has a good case. Like you all say the guy was not too bright to stand near the ladder. Best buy should have relized that. They should not let customers near the ladder when the associates take down merchandise.

I know for a fact that Best Buy does have a safety policy written that dictates how an employee is supposed to get a heavy item off of the top shelf. Now, do the employees follow that policy? I say 80% of the time yes. Within that other 20% employees, customers, and products are usually the victim of minor to very serious accidents.

Everyone who's worked in the service industry should know that 70% of all customers are morons. I don't know how some people can put on their shoes in the morning when they can't even open a door that says "PULL" on it and bang on it waiting for someone to let them in.

That said, it's the businesses job to protect these morons when they are in the store. When I worked at Office Depot we were instructed to keep customers at a safe distance when bringing down heavy items. If this guy wasn't told to stand away from where the TV fell, then it's Best Buy's fault he got hurt. The guy was probably on a cell phone and didn't even look up to see the TV hit him.

The guy didn't drop the TV on himself so you can't compare it to the woman who spilled coffee in her lap. That coffee did violate FDA regulations on the temperature and there were medical reports and photos of the burns she sustained. That's why she won.

I slipped once while walking around a Target store and maybe it was my upbringing, but I didn't even think to sue. In fact, I was so embarassed that someone might've seen me that I got up quickly and walked away. I think a lot of people have a "victim" mentality these days and just walk around as vessels that life acts upon instead of being solid people who act upon life. I'm surprised there aren't more criminals here just taking things from people who have no idea of their surroundings. I was raised to believe that ultimately we are responsible for our own safety and well-being as adults. Good thing he's suing Best Buy, now maybe they'll install those life saving air-bags on all thier heavy top shelf merchandise! If I were this guy I would've seen the situation as dangerous and life-threatening and informed the stock boy of the danger and asked if he were following correct procedures. I can see this guy wiping his ass in the Best Buy bathroom, falling off the toilet, and then trying to sue them for improper toilet safety. Incidentally, wasn't there a case recently where an older gentleman in the US (of course) glued his own buttocks to a bathroom toilet seat in Home Depot and then tried to sue them? He claimed some teenagers must've put the glue down and that he called and called for help but no one heard him. Of course the police busted him after a short bout of questioning. Turns out he glued himself to the seat to sue Home Depot for big bucks. Truly a sad world in which we live.

Coffee physically can not be heated hot enough to cause a 3rd degree burn, the first characteristic of a 3rd degree is 'Charred skin'. Ya silly geese.

Maybe the employee and the customer are in together on it. "Drop a TV on my head, and Ill split the winnings with ya." :-O

Coffee can be heated enough to cause a 3rd degree burn and I saw the pictures on the news when this happened. Even water can do that kind of damage if it is superheated in a microwave. Remember, the coffee is in an enclosed container that contains the vapor where heat would normally escape. When the coffee spilled, the old woman got the full blast of it.

I still can't believe someone would compare slipping on the floor to having a large TV dropped on his head. The two aren't even remotely similar.

Also... How about putting hard hats in the beginning of the store, Offer kneepads, Protective goggles.
