Despite all the fluff Ebay uses to put 'teeth' into the 'seriousness' of the 'legally binding contract' - they are powerless to enforce anything, except to caution the bidder. The seller here can try sueing - but I'll bet the guy has nothing, and did it as a joke. Joke's on the seller unfortunately. Bit of news is about all it amounts to.

If you read the fine print on ebay. If you bid and you win you have contractually agreed to pay the seller.

Most likely the guy doesn't have two nickels to rub together to start a fire, but he should be sued for any nickels he may ever come into possesion of at a later date.

Seller and buyers are scammers on there.

There are loser that are splitting thier vista purchase and selling the 32 and 64 bit versions seperately. Basically doubling their money, and buy the time the smoke clears and their license is revoked the bidding is weeks away.

The two versions come together in one purchase, but one one can be active..

That legally binding contract is a joke. Just go on there and read the negative feedback. I wouldn't bid for anything larger than the amount I'm willing to lose should all go wrong.

Yeah right... Their gonna chase down thousands of crooks to prosecute them in their respective jurisdictions. If that was true then they'd start with all of the losers that scammed people.

What I can't understand is why people continuously bid over 200 for products the seller will only insure it for 200. I saw someone bid 500 plus for a graphics card valued at 550 and only insure uo to 200.

Am I missing something? Why would anyone take a chance on this? especially if the number is the number is so close to buying one from a legit store...

I doubt the seller will get much (if anything) by taking the bidder to court. The seller should leave a negative feedback for the bidder at eBay to warn others.

For all the horror stories you hear on eBay, in reality it is not that bad. With millions (?) or transactions a day, of course fraud is going to happen. I still don't personally know of anybody that has been defrauded on eBay. Sure as a seller you do get the occasional non-paying bidder, but then you either just put the item up again or sell to the next highest bidder. I deal with sellers on eBay every day for my job and we've never had a major problem (4 years now).

The UCC governs sale of goods in excess of $500, so it applies here. The bidder has the right to withdraw any bid before the end of the auction and does not revive any previous bid. Upon the end of the auction a contract is formalized and it becomes enforceable by law.

For ~ $10M, I would take legal action against the bidder. What he should do in reality is resell the car and sue for the difference between the final ebay bid (plus incidental damages) and what he resells it for. That would be the best option.

With the fraud on ebay there is a limit to what they can seek damages for, there is no need to investigate fraud of $10, but $10m... slightly different.

It is true that ebay has millions of transaction a day, however, I frequently find counterfeit items there and has completely stopped purchasing items there. The funny thing is most items found there are close to the retail price unless it can be coutnerfeited. Just take a look at the "expensive" Gillette razor blades etc....

I don't trust ebay sellers, as probably most of them sell counterfeit products from Asia and the few that are honest is overshadow by the bad apples. Because you don't know you have been scammed, doesn't mean it does not happen.

We have all thee kids that cant be prosacuted as adult's and don't have 2 nickel's to rub togeather anyway. Back when we were doing assalt rifles on ebay you couldent bid on a AR upper without some kid outbidding you that never intended on paying for it. And couldent pay for it if he had to.And it dosent matter what the item is vid card or what ever if these kids and juviniles whatever age they are cant buy something for pocket change they dont want you to be able to buy it either. That's why they do this.

Hear in KC if you put a car up for sale in your front yard with a for sale sigh and some kid askes if he can buy it less if you say no they throw a brick threw yor windshield it's the same deal on ebay. And negitive feedback mean's nothing they just open another account under anoither variant of there name with a friend's address. I saw a earlier feedback that said dont ever buy anything on ebay for a amount of money that you cant afford to loose. because if you do the ebay thing you will get scrued ocasionally. I just try to keep my deal's under a copple hundred. This is just a new ver of mail fraud. I had a canadian kid do me out of a used copy of COD when it came out. In this country it would have been a felony useing the mail.But in canida you cant do anything.

HE can get Damages equal to what he does not recover from selling the item to another bidder. So if he sells it for 1 million dollars then the previous is liable in most states for the difference.

Suing someone means nothing. If he hasn't got it you'll never see it. Go back to the beginning and start over again. Must be some sucker out there who wants it that bad.
