Class action law suit against the IRS, anyone?

Realize, the IRS has unlimited funds and all the time in the world. Not only could they afford to lose, it really wouldn't make any difference to them. Outcome of this would be squelched in the news if it reflected bad on them, PR is about the only thing that seems to matter to them. Oh, yea, do you realize, income tax is voluntary? We the People have lost control over this govt entity. A class action law suit would be like stink on a skunk: fun at first, then it would get old real quick.

As far as I know the IRS are not officially a government agency. They are much like NASA they just get tons of funding from the government but they technically are a independent company.

In such a lawsuit they could claim that there were no damages and cite the fact that there is no law requiring anyone to pay an income tax, so the lost data was given to them voluntarily in the first place.

Still waiting for my refund...

What is the big deal that the IRS lost the laptops they send paper work by mail and they put so much paper work in one envlope they can't seal it and when you get it their is your ssn looking you in the face on top. I hear they send most of the tax forms to India to be checked instead of here at home so why do we need the IRS anyway! The little guy pays and the big guy said screw them the little guy will pay.

If a tax liability exists then you have to pay off that liability. The voluntary part is your determining the extent of liability. If you can get the liability to Zero then its a 100% refund of any withholding withheld. (State and Federal)

The basic thing is that you may be filling the role of Trustee for a trust created by the social security administration when they sent you a card that doesn't belong to you (if you read the back of the card is says just that) which you signed.

If there is a tax liability then the liability must be paid to stay within the law. The voluntary part is only with your deciding how to determine the liability instead of letting the IRSDOT do it for you, and they will do it for you if you don't.
