Cupertino (CA) - Apple will pay Burst.com $10 million as part of a legal settlement between the two corporations.

The feuding tech companies reportedly came to an agreement in the latter part of last week.  In exchange for the $10 million cash settlement Apple will pay to Burst, the Internet firm has agreed to give Apple immunity over contentions with its new DVR patents, which came into question after the lawsuit was originally filed.

Burst.com, which specializes in audio/video-over-IP software, filed suit against Apple in 2004 saying that the iTunes and Quicktime software infringed on its patents.  Apple originally said the claim was meritless but has since remained quiet about the ordeal.

As part of the settlement, Apple will gain licensing rights to Burst.com's patents so it can maintain the software applications.  Additionally, Apple's countersuit against Burst has effectively been dropped.

Before settling with Apple, Burst had also sued Microsoft for similar patent infringement issues.  That case netted Burst a cool $60 million.  Earlier this month, a judge leaned on Apple's side by dismissing 14 of Burst's patent infringement claims.  The trial had been scheduled to resume next February.
